These GENERAL CONDITIONS OF SALE of EUKARYA CHOCOLADO SL. (hereinafter “EUKARYA”) regulate the process of online sales made through our website www.eukaryaxocolata.cat.

The Customer consumer declares to be over 18 years old and to have the legal capacity and to act sufficiently to sign contracts of economic content. In the case of the Customer legal entity, the natural person acting on his behalf and representation declares that he has sufficient representation in his favor by the legal entity at the time of the transaction.

These general conditions may be modified at any time by EUKARYA. Notwithstanding the foregoing, purchases made prior to such modifications will not be affected and will be subject to the conditions in force at the time of the purchase in question.

Products, product availability and validity of the offer

All orders are subject to product availability. In the event that there is no stock of the products or difficulties in supplying them, this will be indicated on the website itself or, where appropriate, EUKARYA will contact the Customer and refund any amount paid in this regard.

Any offer made by EUKARYA is subject to the validity indicated or, failing that, for the period available to the Customer.

Price

The prices on the website are in Euro currency and include Value Added Tax (VAT), excluding shipping costs and any other fees that, where applicable, will be indicated separately.

The selling prices will be those in effect at the time the order is placed. EUKARYA reserves the right to change prices at any time. Notwithstanding the foregoing, these variations will not affect orders for which the order has already been confirmed prior to the variation.

Payment

Once all the products have been selected by the Customer, they will appear in the shopping cart with the total price details (including VAT) and then the Customer must process the order and make the payment. Therefore, it will be necessary to complete the information requested at each step of the purchase process, being able to modify the order data at any time before making the payment.

The payment of the purchase of the products on the part of the Client can be made by credit card. The accepted bank cards are Visa and Mastercard.

By clicking on “Authorize payment” the Customer declares that he/she is the holder of the chosen means of payment and that he/she has expressly authorized the bank operator to debit the corresponding amount from his/her bank account. Credit cards are subject to checks and authorizations by their issuing entity, and in the event that such entity does not authorize the payment, EUKARYA will cancel the order.

For your security EUKARYA has relied on the credit card payment system in a payment gateway. The bank details entered are encrypted and transmitted securely to the servers of the bank and then verified with the issuing bank to prevent fraud and abuse.

Invoice

The Customer will receive by email after delivery an email with details of the products delivered, their prices, discounts and costs of the preparation and shipping service and the total amount of the service.

The Customer who wishes to receive an invoice must request it before finalizing the purchase. It will be sent to the e-mail address provided in PDF format for later downloading.

Delivery

Delivery of products purchased through the website is limited to the following territories:

The products will be delivered to the Customer by shipment to the delivery address indicated by the Customer when placing the order.

Delivery times are between 24 and 72 working hours (excluding Saturdays, Sundays and public holidays) from the time the order is confirmed, for which purpose the Customer will receive a confirmation email and tracking until receipt.

The delivery times indicated are approximate and EUKARYA will try to respect as much as possible the expected delivery date. EUKARYA will not accept penalties and decline all responsibility for delays in delivery due to force majeure or causes beyond the company’s control. In case of delay in delivery within the period indicated, will not entitle the customer to cancel the order or to claim any compensation to EUKARYA.

For orders placed in the following countries the cost of transport amounts to the following prices for amounts less than 75 euros and shall be borne by the customer.

  • Spain, except Balearic and Canary Islands: 8,95 €.
  • Balearic Islands: 10,80 €.

For orders for an amount equal to or greater than 75 €, the cost of transport will be borne by EUKARYA.

For orders placed in the following countries: the cost of transport amounts to the following prices for amounts less than 120 euros and will be borne by the customer.

  • Canary Islands 24,00 €.
  • Andorra: 22,00 €.
  • Portugal: 22,00 € 22,00
  • France and Italy: 22,60 €.
  • Germany, Belgium, Holland and Luxembourg: 22,60 €.
  • Bulgaria, Denmark, Estonia, Ireland, Greece, Croatia, Cyprus, Latvia, Lithuania, Hungary, Malta, Austria, Poland, Slovenia, Slovakia, Finland: 23.80 €.
  • United Kingdom: 36,00 €.
  • Switzerland: 35,00 €.

For orders for an amount equal to or greater than 120 Euros, the cost of transport will be borne by EUKARYA.

It will be considered that delivery has occurred at the time the product has been delivered to the Customer or a third party indicated by the Customer acquires the material possession of the order, evidenced by the signature of the receipt of the order at the agreed delivery address.

EUKARYA is exonerated from any liability for the impossibility of delivery of the product in case of error in any of the data provided by the Customer.

EUKARYA reserves the right to cancel any order when it deems appropriate, communicating to the Customer and justifying the decision not to serve the order for reasons beyond its control or force majeure, such as traffic accidents, adverse weather or others. In these cases, we will give the Customer the option to receive a new similar order as soon as the external causes are solved or to be reimbursed for the cost of the order placed.

Responsability for defects

At the time of receipt, the Customer must verify the good condition of the products delivered and that they correspond to the order placed. In case of any incident in this regard it should be noted on the delivery note of the carrier and communicate it in writing to EUKARYA within a maximum period of 24 hours. After that period, it will be considered that the Customer is satisfied with the delivery of the order.

Withdrawal

The Customer may exercise the right of withdrawal within a maximum period of 14 calendar days from the date of receipt of the product by the Customer.

In any case, to accept such right of withdrawal will be necessary to meet the following requirements:

The products must be in the same condition as when they were received, including the original packaging.

The products must not be defective.

Personalized products and sealed products that are not suitable to be returned for hygiene or health reasons and have been unsealed after delivery cannot be exchanged or returned.

Neither can be exchanged or returned products with a shorter expiration date or that must be kept refrigerated and the cold chain has not been respected.

The shipping costs of the products to be returned shall be borne by the Customer. Exceptionally, if a defective product has been received or does not correspond to the purchase made and the Customer decides to return it by mail, he/she must include in the package the proof of shipping costs. Once verified the condition of the products and confirm the defective nature of the delivery, EUKARYA will reimburse the Customer the amount of the returned products and the corresponding shipping and return costs.

Upon receipt of the returned products, EUKARYA will verify their condition and only when they are in perfect condition will proceed to exchange or refund the corresponding amount. The payment will be made with the same payment method used in the purchase, within a maximum period of 14 calendar days from the date on which the exercise of the right of withdrawal was reported.

To exercise the right of withdrawal, the Customer must contact EUKARYA. EUKARYA’s contact details are available at the beginning of this document.

Products and intellectual property

The description and technical specifications of the Products included in the online catalog, data sheets or other are indicative and not binding.

The photographs, images and graphic material contained in the website and online catalog are the property of EUKARYA and are protected and protected by the Intellectual Property Law.

Any third party shall refrain from carrying out any treatment of the images contained in the catalog indicated, consisting of its reproduction, manipulation, distribution or public communication without the express prior authorization or consent of EUKARYA.
